An Equal Rights Amendment (ERA) to our New York State Constitution sounds appealing. After all, who doesn’t support equal rights for all? We believe everyone does! But here’s the issue:
Our equal rights are already safeguarded by the NYS Constitution and various laws, making this proposed ERA unnecessary. So why are the Democrats, who control Albany, pushing to insert redundant language into the Constitution? Because they have a hidden agenda. New York is dominated by one party—the Democrats—with a super-majority in the Legislature and both the governor and Attorney General aligned with them.
Proposal 1 will be on the ballot this November 5th and could have wide-ranging, harmful consequences. It threatens the integrity of girls’ sports, undermines parental rights, and extends constitutional protections to illegal aliens. If passed, Proposal One could:

- Prohibit educational institutions for barring biological males for participating in female sports.
- Allow biological makes to use female locker rooms, restrooms, and related facilities.
- Grant minors the right to medical treatments and procedures, including gender transition drugs and/or surgeries, without parental consent.
- Override existing statutes limiting medical intervention to children.
- Ban schools from disclosing to parents when their child is considering or transitioning their gender.
- Extend constitutional protections to illegal aliens.
- Open the door for a slew of radical bills that would destroy parental oversight and involvement in their children’s education and medical decisions.
- “Abortion” isn’t mentioned in Proposal One (ERA), yet Democrats insist on defining this constitutional amendment as being all about abortion, that is a lie, easily refuted by simply reading the text of the amendment. This is a tactic to boost voter turnout as their support dwindles.
- Protect your rights, stand up for parents, and save girls’ sports, Vote No on Proposal One- November 5th.
Here is the Language that will be on the back of your November 5th ballot:
Section 1. Resolved (if the Assembly concur), That section 11 of article 1 of the constitution be amended to read as follows:
§ 11. a. No person shall be denied the equal protection of the laws of this state or any subdivision thereof. No person shall, because of race, color, ethnicity, national origin, age, disability, creed [or], religion, or sex, including sexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes, and reproductive healthcare and autonomy, be subjected to any discrimination in [his or her] their civil rights by any other person or by any firm, corporation, or institution, or by the state or any agency or subdivision of the state, pursuant to law.
b. Nothing in this section shall invalidate or prevent the adoption of any law, regulation, program, or practice that is designed to prevent or dismantle discrimination on the basis of a characteristic listed in this section, nor shall any characteristic listed in this section be interpreted to interfere with, limit, or deny the civil rights of any person based upon any other characteristic identified in this section.
§ 2. Resolved (if the Assembly concur), That the foregoing amendment be submitted to the people for approval at the general election to be held in the year 2024 in accordance with the provisions of the election law.
