Uniting NYS is proud to announce that we have teamed up with a group of NYS Legislators, and together we are suing Governor Hochul, DOH Commissioner Bassett, the Department of Health, and the Public Health & Health Planning Council over their illegal forced “Isolation and Quarantine” regulation!  We are proud to be standing together as Petitioners with Senator George Borrello, Assemblyman Mike Lawler, and Assemblyman Chris Tague in our pursuit of justice.  We have additional support from Assemblyman and Minority Pro Tempore Andrew Goodell, Assemblyman and Minority Leader William Barclay and Assemblyman Joseph Giglio who have filed an amazing Amicus Brief in favor of our case!

The Regulation…

10 NYCRR 2.13 “Isolation and Quarantine Procedures”
  • Allows the DOH to pick and choose who they want to force to isolate or quarantine, without proof that the person poses a health threat, for however long the DOH wishes to force the quarantine, and at a location that the DOH deems appropriate (which can include a quarantine “facility” or detention center).
  • They do not need to prove that you are actually sick.  They can just suspect that you MIGHT be harboring a communicable disease.
  • There is no age restriction, so they can force you, or your child, or your elderly parent/grandparent into isolation or quarantine, for however long they want!
  • It is the antithesis of what our country stands for, so we intend to stop them!

The Lawsuit…

Attorney Bobbie Anne Cox, of Cox Lawyers, PLLC, filed the lawsuit in New York State Supreme Court the beginning of April.  The case is all about separation of powers between the Executive branch of government (the Governor and DOH) vs the Legislative branch of government (our State Senators and Assembly Members).  This “regulation” is really a law that the Governor and DOH are illegally forcing on the people.  Only the Legislative branch has the power to make law.  The Governor and her Department of Health do not have the power to force people to isolate or quarantine.  This is a clear example of extreme government overreach.  When one branch of government usurps the power of the other branch(es), that is tyranny.

Help Us Win!

There are things you can do to help us win this lawsuit.  We are fighting for ALL New Yorkers, so we appreciate everyone getting involved!
  1. Join Uniting NYS…  It’s free.  Just sign up for our emails!  This is the best way to stay informed, and it automatically makes you a member of Uniting NYS.
  2. Become a “Lawsuit Ambassador”… Help us do media outreach and spread the word far and wide about our lawsuit.  Whether it’s in print, online, TV, or other, we need to create a media storm about this anti-American regulation.  Help us get the news outlets to publicize our case.
  3. Ask your NYS representatives to support our lawsuit… Email and call your representatives and tell them that Uniting NYS, along with a group of NYS Legislators, are suing the Governor and DOH over the illegal forced “Isolation and Quarantine” regulation.  Let them know you’d like them to support the case in one or all of the following ways… by making a public statement on their website supporting our case; by writing a letter to the Governor and Commissioner of Health to revoke the illegal regulation; by writing an amicus brief to support our arguments; by proposing legislation that would nullify this regulation; and any other way they think is good.  They can reach out to us at events@unitingnys.com or they can reach out to Attorney Bobbie Anne Cox directly.
  4.   • May 6, 2022 Governor/DOH filed their Answer to our lawsuit, and they filed their opposition to Amicus Brief. Their Answer is LONG and FULL of inaccuracies and misstatements!
  • May 7, 2022 Amici Curiae filed Reply papers to support their motion for Amicus Brief to be permitted.
  • May 9, 2022 We filed brief in support of Amicus Brief
  • May 12, 2022 A WIN! Judge rules in our favor and allows the Amicus Brief!
